About the label
“swiss made software” is the nationally and internationally recognized hallmark of Swiss quality in software development. “swiss hosting” was developed by the “swiss made software” label and is offered exclusively to its holders. As the cloud is still a very new concept, it did not previously have any link with Swissness. “swiss hosting” was developed with the aim of creating a comparable seal of quality. What are the requirements of the "swiss made software" label?
For a service to qualify for the “swiss made” label, the following three conditions need to be met:
- The Swiss share of the manufacturing costs must be at least 60 percent.
- The primary manufacturing process must have taken place in Switzerland.
- The company must have at least one of its main offices in Switzerland and be entered in the commercial register. This means that the company can also be the Swiss subsidiary of a foreign parent company.
The relevant provisions can be found in the Trademark Protection Act (TmPA) of 1 January 2017 (SR 232.11), specifically Articles 48 to 48d TmPA.
What are the requirements of the "swiss made software" label?
- The headquarters of the business and the actual administrative location of the licensee must be located in Switzerland (see Art. 49, para. 1 TmPA).
- Applications, personal data, factual data (company information, financial data, research findings, etc.) must be hosted in a data center in Switzerland. Data protection and data security must be subject to Swiss law.
- For “Software as a Service” (SaaS) solutions, only services for which the hoster also meets the stated requirements are eligible for the “swiss hosting” label.
- Access to the hosting environment and/or the data for operations and administration must be protected by the hoster in such a way that the data continues to remain completely in Switzerland and can be neither viewed nor requested, whether directly or indirectly, by a foreign organization or government.
